I am hoping you might provide some advice on how I may defend a lawsuit imposed on my husband and |

I by Phase V H.O.A. |

We were served with a summons to appear regarding unpaid fines that have (in our opinion) been |
|
|
imposed on us dating back to 2006. |
|
|
I have documentation proving Board agreed to waive fines up to date of meeting, yet these fines were |
|
|
never removed from our account. We have also been fined repeatedly for same two violations. The first is |
|
|
for "missing tree" in our front yard that was destroyed during storm in 2001, but we were not fined for |
|
|
violation until 04/07. I have referred assoction to Az statute. |
|
|
The second is regarding solar panels we installed. The Association is insisting we paint them, even |
|
|
though I have provided letter from Solar panel supplier stating that it would make them ineffective. I |
|
|
brought Associations attention to AZ ars |

Can the builder sit on the board solely with some other phantom names that take up space on the |
|
|
CC&R’s? We had questioned some items on a budget that was drawn up for us by the management |
|
|
company. i.e. landscape contract? We seldom see any landscaping being done. In other words, we don’t |
|
|
know where the money is going. |
